Terms of Service

Please read these terms carefully before using the Arlix platform.

1. Acceptance of Terms

By accessing or using the Arlix platform ("Service"), including our website, mobile applications, and all related services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Arlix Health Technologies Ltd ("Arlix," "we," "us," or "our"), a company incorporated under the laws of the Federal Republic of Nigeria.

We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms. We will notify you of material changes via email or in-app notification.

2. Description of Service

Arlix is a telehealth platform that connects patients with licensed medical practitioners for virtual consultations, digital prescriptions, laboratory test orders, specialist referrals, and related healthcare services.

The Service is intended for residents of Nigeria and is designed to supplement, not replace, the traditional doctor-patient relationship. The Service does not provide emergency medical care. If you are experiencing a medical emergency, please call 112 or go to the nearest emergency department immediately.

Arlix acts as an intermediary platform connecting patients with independent healthcare providers. Doctors on the platform are independent practitioners, not employees of Arlix.

3. User Accounts

To use certain features of the Service, you must register for an account. You agree to:

(a) Provide accurate, current, and complete information during registration; (b) Maintain and promptly update your account information; (c) Maintain the security of your password and account credentials; (d) Accept responsibility for all activities that occur under your account; (e) Notify us immediately of any unauthorised use of your account.

You must be at least 18 years of age to create an account. Parents or legal guardians may create accounts on behalf of minors for the purpose of managing their healthcare through the Family Care feature.

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

4. Medical Disclaimer

The information provided through the Service is for general informational and healthcare purposes only. It is not intended to be a substitute for professional medical advice, diagnosis, or treatment in all circumstances.

While our doctors are licensed medical practitioners registered with the Medical and Dental Council of Nigeria (MDCN), telehealth consultations have inherent limitations. Certain conditions may require in-person examination, diagnostic testing, or emergency care that cannot be provided through the Service.

You should never disregard professional medical advice or delay seeking treatment because of information provided through the Service. Always consult with a qualified healthcare provider regarding any medical condition.

Arlix does not guarantee the accuracy or completeness of any information provided by healthcare practitioners on the platform.

5. Telehealth Consent

By using the Service for medical consultations, you acknowledge and consent to the following:

(a) Telehealth consultations are conducted remotely using audio, video, and messaging technologies; (b) There are potential risks including, but not limited to, technology failures, interruptions in service, and limitations in the ability to perform physical examinations; (c) The healthcare provider may determine that telehealth is not appropriate for your condition and may recommend in-person care; (d) You have the right to withdraw your consent and discontinue a telehealth consultation at any time; (e) Your consultation may be documented in electronic health records maintained on the Arlix platform; (f) The laws of the Federal Republic of Nigeria protect the confidentiality of your health information.

You agree to provide honest and complete health information to your healthcare provider during consultations.

6. Payment Terms

Consultation fees and other service charges are displayed on the platform prior to booking. By proceeding with a booking, you agree to pay the applicable fees.

Payments are processed securely through our payment partner, Paystack, and are subject to their terms of service. We accept payment via debit/credit cards, bank transfers, and USSD.

Refund Policy: You may be eligible for a refund if: (a) A consultation is cancelled by the doctor or due to a platform error; (b) You cancel a scheduled consultation at least 2 hours before the appointment time; (c) There is a verifiable technical failure that prevents the consultation from taking place.

Refunds are processed within 5-10 business days. Completed consultations are generally non-refundable. Disputes should be reported within 48 hours of the consultation.

7. Privacy

Your privacy is important to us. Our collection, use, and protection of your personal and health information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using the Service, you consent to the collection and use of your information as described in our Privacy Policy, in accordance with the Nigeria Data Protection Act 2023 and regulations of the Nigeria Data Protection Commission (NDPC).

8. Intellectual Property

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, icons, images, audio, video, software, and the overall design and arrangement thereof, are owned by Arlix Health Technologies Ltd or its licensors and are protected by Nigerian and international copyright, trademark, patent, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any material from the Service without our prior written consent, except as permitted by these Terms.

The Arlix name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Arlix Health Technologies Ltd. You may not use these marks without our prior written permission.

9. Limitation of Liability

To the fullest extent permitted by Nigerian law, Arlix Health Technologies Ltd, its directors, employees, partners, agents, suppliers, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

(a) Your access to, use of, or inability to access or use the Service; (b) Any conduct or content of any third party on the Service, including healthcare providers; (c) Any content obtained from the Service; (d) Unauthorised access, use, or alteration of your transmissions or content.

Our total aggregate liability for any claims arising from or related to the Service shall not exceed the total amount paid by you to Arlix in the twelve (12) months preceding the claim.

Nothing in these Terms shall exclude or limit liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or the Service shall first be resolved through good-faith negotiation. If negotiation fails, the dispute shall be submitted to mediation and, if necessary, arbitration in Lagos, Nigeria, in accordance with the Arbitration and Mediation Act 2023.

The courts of the Federal Republic of Nigeria shall have exclusive jurisdiction over any matters not subject to arbitration under these Terms.
